Marijuana Expungement
On November 8, 2022, the People of the State of Missouri voted for the passage of Amendment 3, thereby decriminalizing marijuana under local and state law and mandating the automatic expungement of criminal history records related to marijuana offenses. Amendment 3 went into effect as Article 14, Section 2 of the Missouri Constitution on December 8, 2022.
Article 14 requires the circuit courts to automatically order the expungement of all misdemeanor and felony marijuana records as provided below.
Misdemeanor Marijuana Offenses - To Be Expunged by June 8, 2023
Conditions:
- The individual is no longer incarcerated or under the supervision of the department of corrections.
Felony Marijuana Offenses - To Be Expunged by December 8, 2023
Conditions:
- The individual is no longer incarcerated or under the supervision of the department of corrections;
- The individual has completed their sentence for any felony marijuana offenses and any marijuana offenses that would no longer be a crime after the effective dates of sections 1 and 2 of this Article, excluding the following types of offenses:
- Distribution or delivery to a minor;
- Any such offenses involving violence, or
- Any offense of operating a motor vehicle while under the influence of marijuana.
